Summary/Background:

The New Mexico Alcoholic Beverage Control Division has an impartial person to measure the distance of the nearest school and church. The Department of Public Safety is hired to do independent measurements. When the applicant goes to the state preliminary hearing, the application is reviewed, and any necessary corrections are made. If the distance is closer than 400 feet, the applicant must get a survey, and if it is within 300 feet, a waiver is required.
