The Regular Meeting of the Taos Town Council was called to order by the Honorable Mayor Darren M. Cordova at 1:38 p.m.

UNDER ITEM 8-A Change name from Lorenzo Lucero to Ben Bilal.
ADD EXECUTIVE SESSION pursuant to NMSA Section 10-15-1.H(7) to discuss Spring Ditch Pending Litigation. No Action will be taken.
DELETE ITEM 8-C (Under Matthew Spriggs, Community & Economic Development Director with Matthew Foster, Long Range Planner) Request for approval of out-of-state travel for Matthew Foster, Long Range Planner, to attend a watershed planning course in Bandera, Texas, from May 10th - May 14th. The course tuition and travel expenses will be paid by Amigos Bravos. The course is important and relevant to the Land Use, Open Space, and Natural Resources Elements of the Comprehensive Plan.
DELETE ITEM 8-D (Under Matthew Spriggs, Community & Economic Development Director with Matthew Foster, Long Range Planner) Presentation and update regarding the Energy Conservation and Efficiency Block Grant. The Town was awarded $490,490 from the American Recovery and Reinvestment Act to install solar panels on Town Hall, to provide staff training to implement the requirements of the High Performance Building Ordinance, to complete an energy and environmental audit of town buildings, to inventory green house gas emissions, and to conduct four public education workshops regarding energy efficiency and the requirements of the High Performance Building Ordinance. Staff will update the Town Council and provide information about the budget, schedule, and tasks of the grant.
Mayor Pro Tem Abeyta made a motion to approve the agenda as amended. Councilmember Silva seconded the motion. The motion carried unanimously.

Councilmember Silva made a motion to approve the Minutes of March 23, 2010 Regular Meeting as presented. Councilmember Quintana seconded the motion. The motion was approved by an affirmative vote. Those voting AYE were: Mayor Pro Tem Abeyta, and Councilmembers Sanchez, Quintana and Silva.

| Presentation of Proclamation Mayor Cordova presented a proclamation to Carmen Cameron Wolfe declaring April 24, 2010, as T'ai Chi and QiGong Day.

Mayor Cordova advised the audience that during the Citizens Forum he would not allow comments on agenda item No. 8-E regarding the surrounding use of public space for Arts and Crafts Fairs until the item was presented by staff. He also stated the Citizens Forum was not a public hearing regarding the Arts and Crafts Fair and wanted to make it very clear that a decision would not be made today; however, the staff would provide a briefing as to what they have come up with thus far. Mayor Cordova requested citizens to step forward to speak under the Citizen Forum not relating to the Arts and Crafts Fair.

| Rocky Mountain Youth Corps | |
| Jamie Radenbaugh with Rocky Mountain Youth Corps came forward to inform the public of upcoming events for the month of April which includes hosting a Safety 101 Seminar with IMPACT Personal Safety; Taos Earth Day Festival in collaboration with the New Mexico Solar Energy Association; Acequia cleanup throughout the park; and the opening of the hiring season for summer youth programming.
Mayor Cordova stated that one of Council's priorities is to support the Rocky Mountain Youth Corps in securing federal funding that they are allotted. Mayor Cordova thanked Rocky Mountain Youth Corps for doing an exceptional job in completing the Town's trails.

| Paul Lukes, founder of Smart Minds Group, presented to Town Council a proposal for a multi-faceted plan for reducing drug and alcohol related crimes and deaths and replacing these negative activities with entertainment and events known as "Sober Nightlife" in collaboration with the Town of Taos.
Mayor Cordova thanked Mr. Lukes and requested that Daniel Miera, Town Manager, look into this proposal. Councilmember Silva thanked Mr. Lukes for his stand in abstaining from alcohol and drugs and stated he admired Mr. Lukes' perseverance and encouraged him to continue in his efforts.

Kathleen Burg provided information on programs available thru Chesed Project which offers support to the elderly and seniors, individuals with Alzheimer's and their caregivers in Taos County.

| Presentation by Rose Bauhs Rose Bauhs, Safe Routes to Schools Coordinator, presentation regarding the United States Department of Transportation Announcement - New Planning Policy Regarding Bicycling/Pedestrians. | |
| Ms. Bauhs stated one of the purposes of the Safe Routes to Schools is to enable and encourage children of all abilities to walk or ride a bike to school and was happy to report this has been accomplished at the Taos Charter School. She further stated she would like to encourage the Town to have facilities for bicyclists and pedestrians and that these facilities be included in roadway projects to facilitate more safe routes to schools and throughout our community.
Councilmember Quintana thanked Ms. Bauhs for her presentation.

| Eric Montoya, Administrative Fire Chief introduced Bin Bilal with Rocky Mountain Youth Corps. Mr. Bilal stated much of Taos is in a wildland urban area and fire danger in Taos is partially high. He explained how to improve the odds of house and personal survival during a wildfire. Dylan Lujan and Lorenzo Lucero also assisted Mr. Bilal in his presentation on how to be fire wise.
Mayor Cordova stated this information was very beneficial for the public to know. Mr. Bilal stated that the youth corps members made the effort in organizing public awareness to the citizens of Taos as a community service.

| Francisco "French" Espinoza, Public Works Director Consideration and approval to purchase a replacement skid steer loader for the Recycling Center. The purchase will be through State Price Agreement #90-000-00-00056 as awarded to Tom Growney, Inc. purchase amount is $39,044 as outlined on Product Quotation (attached). Budget Line Item: 65-31-45005.

Francisco “French” Espinoza, Public Works Director requested approval to purchase a Bobcat skid steer loader from Town Growney Equipment. Mr. Espinoza informed the Mayor and Council that the procurement process was met and stated he also looked into the GSA Contract and the HGAC Contract to verify if lower prices were available and they were not. He further stated that Town Growney Equipment is on state contract.
Mayor Cordova asked if this purchase was budgeted. Mr. Espinoza stated the purchase was budgeted under line item 65-31-45005 and further stated the purchase price of $39,044 will include forks and a snowblade for snow removal.
A discussion took place as to why the purchase went thru state contract rather then going out for bid. Councilmember Silva informed Mayor and Council that Bobcat is probably the best on the market for this type of equipment and the price range seemed fair. He commended Mr. Espinoza for doing a good job.
Councilmember Silva made a motion to approve the purchase of a Bobcat skid steer loader as presented. Councilmember Quintana seconded the motion. The motion was approved by an affirmative vote. Those voting AYE were: Mayor Pro Tem Abeyta, and Councilmembers Sanchez, Silva and Quintana.

Matthew Spriggs, Community Economic Development Director advised Mayor and Council the process has been very difficult and unfortunately an agreement has not yet been reached. Because a decision would not be reached he and his staff did their best in providing a fair process to give everybody an opportunity to give their opinion and put forward their creative ideas and try to come to a reasonable accommodation. He stated since that did not happen he and his staff are presenting their best possible recommendation which would be fair to all parties involved.
He read the following staff recommendations for the record:
Pass an ordinance that will enable the Town Council to annually set the calendar for major events on holiday weekends on Town owned properties. The calendar would be set in January for the calendar year by resolution. This provides the Council with flexibility to adjust to economic conditions and any additional data that is provided.

For the calendar year 2010 we recommend that Kit Carson Park be reserved for use by the public for family oriented events on Labor Day weekend and that no major or commercial event permits be issued for that weekend. We believe that this should be continued in 2011 and that the Town examines the impact of this action. Should Labor Day weekend be made available in the future, it would be appropriate to provide the current Arts and Crafts Fair promoter, Blue Skies Productions, with the right of first refusal for the permit on that weekend.

We recommend that this calendar remain consistent for at least 2 years. This would allow for incremental change if the Council desires to move events off of other major holiday weekends. This would mean permitting events for Memorial Day and 4th of July during this period of consistency.

The Yuletide Festival plays an important role in the celebration of the winter holidays and the proceeds from this event pay for decorations throughout the community and particularly the historic district, the farolitos, and the annual tree lighting. It also is a very different kind of event that is geared toward local and visiting families and is mostly composed of local entrepreneurs and merchants. This event includes public performances by various children’s performing art groups. Arts and crafts are only one element of this multi-faceted family event. We recommend that the Yuletide Festival continue its tradition of providing this family event over Thanksgiving weekend.

We strongly recommend gathering factual data to support any future decisions. That data should examine the past 5 years of economic activity to provide a baseline to measure the effect in future years.

We have a concern that the fees charged for these public spaces do not equal the cost bourn by the public. Steps should be taken to ensure that public benefit exceeds public cost. Some additional consideration should be given to charging lower fees to charity events than for-profit events.

It would be a loss for all involved if some of the creative ideas forwarded by the Arts and Crafts Fair representatives and the public were not acted upon. Joint advertising, the provision of a hospitality booth, and other concepts could reduce further deterioration of the local economy. We are very appreciative of the efforts of the general public and the Arts and Crafts Fair representatives.

In the event that Arts and Crafts Fairs cannot be held on Town property during holiday weekends, it has been suggested that the Fairs be relocated to another suitable site. Suggestions of new sites have included:

Filemon Sanchez Park

The new County Administration Park

Of the suggested alternate sites, both groups agreed that Parr Field would be the best of the potential sites if Kit Carson Park were unavailable.
Mr. Spriggs stated the Arts and Cultural District Steering Committee is hopeful and believes that this recommendation will allow the community to move forward in a positive manner and will accommodate all concerned. He further stated the direction of the Arts and Cultural District is to revitalize Taos and reaffirm Taos’ rightful place as a world class Art Colony. He believes Arts and Crafts Fairs and other cultural and artistic events are an important aspects of artistic entrepreneurial activity in addition to the established galleries, downtown businesses, and entertainment and cultural facilities.
Mayor Cordova advised the audience he would allow ten minutes for public comment under the Citizens Forum since a decision was not going to be made today. He further stated the recommendation presented by Mr. Spriggs had not been reviewed by Council until today and time was needed to analyze it. The following people came forward to speak:
- John Staple, an artist and the owner of Touchstone Inn and Gallery stated that a number of people, not just the galleries, depend on art as an entrepreneur spirit.
- Jalmar Bowden, coordinator of the August Annual Summer Arts and Crafts Festival, stated the proceeds benefit the Community Against Violence Shelter. Mr. Bowden made a recommendation that no festival be removed from its customary location and that it be afforded protective status in issuance of permits on traditional use basis.
- Jean Verheyden, a Spring Arts participant, urged to keep the Arts and Crafts Fairs because less visitors means less money for everyone.
- Vikki McFadden, a shop owner in Town, and also a show organizer for the Arts and Crafts Fairs, stated the fairs are a family friendly environment. Ms. Mcfadden recommended keeping the dates as is and work together.
- Judy Terra, a sixteen year resident and a owner of a studio gallery in Ranchos, stated Art Shows provide the opportunity for hard working artists to make a modest living and be able to continue to reside in Taos.
- Robert Nightingale, owner of a small business for nineteen years, stated if more events get cancelled it could really backfire.
Mayor Cordova instructed the Town Manager to review the recommendation submitted by staff; meet with each councilmember individually to discuss their point of view on the issue; and then brief him on his findings. Mayor Cordova further added before a decision is made there will be a fair and open process for public comment.
Mayor Pro Tem Abeyta challenged both sides to work with each other. He clarified the intent of the Town is not to do away with the Arts and Crafts Fairs. Mayor Pro Tem Abeyta thanked Mr. Spriggs and Ms. Spray for their recommendation and stated he liked their recommendations.

Councilmember Silva made a motion to go into Executive Session pursuant to NMSA Section 10-15-1.H7 to discuss the Spring Ditch Pending Litigation. No Action will be taken.
Councilmember Quintana seconded the motion. The motion was confirmed by an affirmative vote. Those voting AYE were: Mayor Pro Tem Abeyta, and Councilmembers Sanchez, Quintana and Silva.
At 3:48 p.m., Councilmember Silva
made a motion to come out of Executive Session and stated discussion in the Executive Session was limited to the item as it was called for. Councilmember Quintana seconded the motion. The motion was confirmed by an affirmative vote. Those voting AYE were: Mayor Pro Tem Abeyta, and Councilmembers Sanchez, Quintana and Silva.

A motion was made by Mayor Pro Tem Abeyta and seconded by Councilmember Quintana to adjourn the meeting. The motion carried unanimously and the meeting adjourned at 4:00 p.m.
