A.Case No. PZ 2013-26-Preliminary Hearing
Del Norte Properties, LLC/Glen Michael Tarleton, property owner, Mark Yaravitz, agent is requesting site plan approval for the construction of an 18 unit apartment complex, currently known as the Tarleton Apartments.  The parcel is currently zoned both R-14 “Multi-Family Residential” and C-2 “General Commercial”.  The parcel is approximately 1.50 acres in size and is located at 402 Paseo Del Pueblo Norte within the Historic Overlay Zone in the Town of Taos. 
B.Case No. PZ 2013-24-Final Hearing
Susan Meikle, property owner and Alex Abeyta, agent, are requesting a variance for the minimum lot size of 7,000 square feet for a proposed lot split of a .22 acre lot into 2 lots of .11 acres each within the R-14 (Multi-Family Residential) zone of the Town of Taos.  This proposed lot split would create two lots smaller than the minimum lot size of 7,000 square feet: one lot would be 4,776 square feet and other lot would be 4,790 square feet.  The existing lot is lot 10 of the Vigil Subdivision on Vigil Street in the Town of Taos
C.Case No. PZ 2013-20-Final Hearng
Frederick W. Burns and Elizabeth Jane Burns, property owners, are requesting a side yard setback variance from the required seven (7) feet to a three foot and 7 inches (3’ 7”) side yard setback on property located at 115 Roberts Lane.  The property is located within the R-14 (Multi-Family Residential) zone of the Town of Taos.
D.Case No. PZ 2013-22-Final Hearing
An Ordinance Adding Conditional Uses to the Town of Town Code Sections 16.16.130 and 16.16.140 et seq. to allow certain agricultural uses in the C-1 “Neighborhood Commercial Zone” and C-2 “General Commercial Zone” and gardening uses in all zones.

The Planning and Zoning Commission Meeting was called to order by Chairman Patterson.
2. ROLL CALL

Ms. Martha Perkins, Planning, Zoning and Buildings Director, called roll.  A quorum was present.  

Those present were:

Late Arrivals were:

Commissioner Lukes made a motion to approve the Agenda as amended.

Commissioner Perez seconded the motion. The motion was Passed. Those voting AYE were: Commissioners: Lea, Garcia, Patterson, Lukes, Perez, Lucero

Mark Yaravitz gave a presentation on Case No. PZ 2013-26, Alex Abeyta also spoke concerning Case No. PZ 2013-26.

Commissioners had a discussion concerning Case No. PZ 2013-26.  Questions and comments from the Commissioners were concerning the acequia and trees.

Chairman Patterson opened the public hearing.

After closing the public hearing, Chairman Patterson asked for questions from the Commission.

Commissioners had a brief discussion on Case No. PZ 2013-26.

Commissioner Lukes made a motion to approve the site plan and application for Case No. PZ 2013-26 based on findings of facts, staff recommendations, and added a condition that the final site plan show the development standards required and how they are being met with this project; the culvert, which is required by the Acequia Association, be indicated on the civil drawings; and clarification for the setbacks on the acequias. 

Commissioner Perez seconded the motion. The motion was Passed. Those voting AYE were: Commissioners:  Romero, Lea, Patterson, Lukes, Perez, Lucero

Commissioner Garcia abstained.

B.Case No. PZ 2013-24-Final Hearing

Martha Perkins read a letter from Josefina Cruz concerning a subdivision.

Ms. Perkins gave a summary on Case No. PZ 2013-24 and a review of the staff report.

Chairman Patterson opened the public hearing.  No one came forward.

After closing the public hearing, Chairman Patterson asked for questions from the Commission.

Commissioner Perez made a motion to deny Case No. PZ 2013-24 based on staff report.

 Commissioner Lucero seconded the motion. The motion was Passed. Those voting AYE were: Commissioners: Romero, Garcia, Perez, Lucero

Those voting NO were: Commissioners: Lea, Patterson

Commissioner Lukes abstained.

C.Case No. PZ 2013-20-Final Hearng
Frederick W.  Commissioner Garcia seconded the motion. The motion was Passed. Those voting AYE were: Commissioners: Romero, Garcia, Lea, Patterson, Lukes

Those voting NO were: Commissioners: Perez, Lucero

D.Case No. PZ 2013-22-Final Hearing

Commissioner Garcia did not accept.

Commissioners voting for Anthony Perez were: Romero, Lea, Garcia, Patterson, Lukes, Lucero

The new Vice-Chair voted in is Anthony Perez.

Commissioner Lukes did not accept.

Commissioner Romero voted for Justin Lea

Commissioner Perez voted for Douglas Patterson

The new Chairman voted in is Justin Lea.

Commissioner Lukes brought up two other matters. 

1.     Concerning the streamlining and when it goes to Council on January 14, 2013
2.     Concerning proposing another criteria for granting Variances

Commissioner Perez brought up two other matters.

1.     Tarleton Matter - Should it have been delayed one month?
2.      Concerning giving the applicant back their binders after the hearings.

Commissioner Lea thanked Chairman Patterson, on behalf of the entire Commission, for his great service as the Chairman.

10.ADJOURNMENT
A motion was made by Commissioner Lukes and seconded by Commissioner Perez to adjourn the meeting.  The motion carried unanimously and the meeting adjourned.
