A.Case No. HPC 2013-3
Case No. HPC 2013-3  Mike Tarleton, property owner, and Mark Yaravitz, agent, have a new set of drawings.  They made small sets for the packets and a couple of large sets for the meeting or if the public wants to see a larger set for the proposed project.
B.Case No. HPC 2013-4
Case No. HPC 2013-4  Joe Wallborn, property owner, and Don Pennington, agent, probably do not need copies made for the Commissioner’s packets.  The Commission wanted to approve the project, but the Code required a final hearing first. 
C.Case No. HPC 2013-6
Case No. HPC 2013-6  Jeffrey Shardell, property owner, and Douglas Patterson with Living Designs Group, agent will need copies made for the Commissioner’s packets.

1. CALL TO ORDER BY THE CHAIRMAN
The Regular Meeting of the Historic Preservation Commission was called to order by Chairperson Spray.

(No Video available for approximately the first ten minutes (per Martha Perkins) of the HPC Meeting. Minutes from Item 1 Call to Order By the Chairman through to Item 7 B Matters from Staff. Case No. HPC2013-4 were completed by Martha Perkins.)

Commissioner Lukes made an announcement that he had to leave early.

4. APPROVAL OF AGENDA
The agenda was changed to move Item 7B Case No. HPC 2013-4 Request for a Certificate of Appropriateness for New Construction and Remodel at 216 Hinde Street, before Item 7A HPC 2013-3 Request for a Certificate of Appropriateness for Construction of an 18 Unit Apartment Complex at 402 Paseo del Pueblo Norte. 
 
Motion was made by Commissioner Lukes and seconded by Commissioner Prinz.

The agenda was amended by deleting items 7D through 7F due to Novus software issues.

5. APPROVAL OF MINUTES
A.August 21, 2013 Meeting Minutes
Motion to approve the minutes was made by Commissioner Prinz and seconded by Commissioner Lukes. The motion carried unanimously and was passed.

7.MATTERS FROM STAFF
A.Case No. HPC 2013-4
Case No. HPC 2013-4  Joe Wallborn, property owner, and Don Pennington, agent, are requesting a Certificate of Appropriateness for new construction and remodel on a non-contributing building within the Historic Overlay Zone of the Town of Taos.  The subject property is .23+ acres in size, is located at 216 Hinde Street, and zoned R-14 "Multi-Family Residential". 
Motion to approve Case No. HPC 2013-4 was made by Commissioner Lukes and seconded by Commissioner Prinz, the motion passed 5-0.

B.Case No. HPC 2013-3
Case No. HPC 2013-3  Mike Tarleton, property owner, and Mark Yaravitz, agent, are requesting a Certificate of Appropriateness for the construction of a 18 unit apartment complex within the Historic Over lay Zone of the Town of Taos.  The subject property where the proposed apartment complex is to be built is 1.5+ acres in size, is located at 402 Paseo del Pueblo Norte, and zoned C-2 "General Commercial" and R-14 "Mulit-Family Residential".

Mark Yaravitz gave a brief presentation on Case No. HPC 2013-3.

Steve McCormick gave a presentation.

Commissioners had a discussion on Case No. HPC 2013-3.

Chairperson Spray opened the public hearing. No one came forward.

Conditions the Commissioners set forth were:
1. Site and Landscaping - Parking needs to conform to the Town's landscape plan requirements and/or conditions to include engineering, drainage and the ditch.
2. Stating the intent of the existing two buildings - upgrade and maintain buildings - preserve, stabilize, re-stucco.
3. Stabilization strategy be established and the building permit be contingent on that being present.
4. A drawing of fence locations relative to existing buildings to protect the existing tenants - construction fencing.
5. A wall removal plan for the existing stucco walls how the walls are to be protected.
6. A detailed plan for driveway and landscape - specifically with erosion and settlement control strategy and a culvert plan - minimum of 18" culvert.
7. Must conform with what the NM State Highway Department asks for protecting the entrance and the adjacent parking.
8. Must protect the acequia
9. Must not name the apartments Dragonfly Apartments or any other name of any other commercial business in the area that does not want to be named or associated with these apartments or any other persons names without permission.

Karen Todd Came forward to speak concerning parking spaces for the Dragonfly Cafe.

Commissioner Choma made a motion to approve the Certificate of Appropriateness with the conditions as mentioned.

Commissioner Palacios seconded the motion. The motion was Passed. Those voting AYE were: Commissioners: Prinz, Choma, Palacios.

Chairperson Spray abstained.

Commissioner Lukes left the meeting earlier and was no longer in attendance

C.Case No. HPC 2013-6
Case No. HPC 2013-6  Jeffrey Shardell, property owner, and Douglas Patterson with Living Designs Group, agent request a Certificate of Appropriateness to remodel and restore an empty, neglected, adobe building approximately a block from the plaza at 209 Ranchitos Road within the Historic Overlay Zone (HOZ) of the Town of Taos.  The property owner would like to demolish the 410 square feet section of the building with the Territorial roof and restore the rest of the building consisting of 665 square feet in the Pueblo/Spanish Revival Style for an art gallery.  Currently, the building is zoned R-14 "Multi-Family Residential".  
Richard Gillahan, with Living Designs Group, gave a review of Case No. HPC 2013-6 to the Planning and Zoning Commission.
 
The Commission instructed Living Designs Group to come back for a Preliminary Hearing with the completed application and completed backup paperwork for the next regular scheduled Historic Preservation Meeting on October 20, 2013.
8.MATTERS FROM THE HISTORIC PRESERVATION COMMITTEE
Chairperson Spray stated she had two announcements.

1. Explanation to Martha Perkins concerning the Chinese Elms and informed her there would be public education before the Chinese Elms start sprouting this spring.

2. Member of the public came forward to Chairperson Spray asking to do a mural so she informed the Commission that a proposal to allow murals would be coming up soon.
Commissioner Choma stated her concerns with the application process in the Planning, Zoning and Buildings Department. She wanted to know who the Code Administrator is and wants the applications to be complete, as stated in the Town Code, before they go to the Historic Preservation Commission.

Chairperson Spray instructed Martha Perkins, Planning, Zoning and Buildings Department Director, to look for the information and/or changes the Historic Preservation Commission worked on a couple of years ago with either Matt Sprigs or Matt Foster.
Commissioner Prinz informed the Commission, Ms. Perkins and the community of the following information and concerns:

1. She is going to protect the Acequias before she leaves Taos.
2. She is working on a list of requirements for drawings that she would be willing to forward to Ms. Martha Perkins.
3. She would like to see the Revised Sign Code Ordinance if it was changed by Council; she would like to get the mural stipulation completed and the neon lights/signs stipulation cleared.
9.ADJOURNMENT
A motion was made by Commissioner Palacios and seconded by Commissioner Choma to adjourn the meeting. The motion carried unanimously and the meeting adjourned. Those voting AYE were: Commissioners: Choma, Spray, Palacios

Commissioner Prinz left five minutes earlier.
